Judge Napolitano on 14-Year-Old’s Lawsuit Against Classmates: I’ve Never Seen a Minor Sue Another Minor Over Cyber-Bullying
A 14-year-old student in Georgia has slapped her classmates with a lawsuit for bullying her on Facebook.
Napolitano said, “It’s very difficult to sue minors for their obligations, so they are probably going to have to sue the parents and to prevail against the parents, they are going to have to show that the parents were willfully negligent. That is, they intentionally look the other way.”
The judge said that the federal government has attempted to regulate such action with the Anti-Cyber Bullying statute, but no children have ever been prosecuted under the statute.
“I have not seen a case where a minor sued another minor because of cyber-bullying. This is virgin territory, Neil. I don’t know where it’s going to go,” the judge concluded.
