Woman Sues Little League Player After Being Hit With Baseball

A New Jersey woman is suing after being hit by a baseball at a Little League game two years ago. It happened while catcher Matthew Migliaccio, who was 11 years old at the time, was warming up before a game. When he threw the ball it didn’t quite make it back to the pitcher.

Elizabeth Lloyd was sitting at a picnic table about five feet away from the bullpen when she was hit in the face with the baseball. She tried suing the Little League, but now she’s suing the boy and seeking at least $150,000 in damages.

Attorney Joey Jackson said on Fox and Friends that there is a legal doctrine

known as “assumption of risk.” He explained, “It means that when you go to a baseball field, you have to be alert, you have to be aware and you have to take precautions so that you don’t get hit … If she was aware and alert, she wouldn’t have been hit. Don’t sue this little child.”

Fox News legal analyst Arthur Aidala said it’s the Little League that should be held responsible for failing to supervise the kids, failing to warn the spectators and failing to have a fence tall enough to protect people.
