Judge Napolitano Analyzes Latest Ruling in Case of Alleged Colorado Movie Theater Shooter
Colorado prosecutors have given up the effort to try to obtain a notebook sent to a psychiatrist by the man accused of killing 12 people at a suburban Denver movie theater this summer.
Prosecutors believe the notebook details James Holmes' plan
to carry out the shooting spree, but the defense argues it is protected by doctor-patient privilege. The district attorney decided to give up pursuing the notebook to speed up the pretrial process.
Judge Andrew Napolitano, Fox News' senior judicial analyst, explained that if Holmes pleads insanity, the notebook would have to be turned over to prosecutors anyway.
