Courts Are Trying to Determine Whether Cellphone Searches Are Legal

Most Americans use their cellphones with great regularity, but just how private are your texts or emails? And, could those messages potentially be used against you in court?

According to Judge Napolitano, while the courts haven’t yet ruled on this issue, police are “persuading Google or whoever it may be to give them this information without a search warrant. Whether they use it in prosecutions and whether that use is upheld by appellate courts remains to be seen.”
