Judge Napolitano Says GOP Must Welcome Illegal Immigrants: It's Their Natural Right to Be Able to Come to U.S.

A bipartisan group of senators is set to announce a plan for sweeping immigration reform. Led by Harry Reid (D-Nev.), the group includes Republicans John McCain (Ariz.), Lindsey Graham (S.C.) and Marco Rubio (Fla.).

The plan has four main goals:

- Creating a path to citizenship for the estimated illegal immigrants already in the U.S., contingent upon securing the border and better tracking of people here on visas.

- Reforming the legal immigration system, including awarding green cards to immigrants who obtain advanced degrees in science, math, technology or engineering from an American university.

- Creating an effective employment verification system to ensure that employers do not hire illegal immigrants.

- Allowing more low-skill workers into the country and allowing employers to hire immigrants if they can demonstrate they couldn't recruit a U.S. citizen; and establishing an agricultural worker program.

On Fox Business Network, Stuart Varney went over the proposed reforms with Judge Andrew Napolitano. Varney said many on the right will criticize this plan for essentially giving amnesty to the roughly 11 million illegal immigrants already in the United States.

Napolitano said the Republicans have to realize that if they don't change their stance, President Obama will "use his powers under federal law" to give illegal immigrants lawful status and simply go around Congress.

"That will add 11 to 13 million new voters to the Democratic rolls. The Republicans need to resist that, not by kicking these people out, not by preventing them from becoming citizens, but by welcoming them with open arms into a party where they would feel more comfortable than the Democrats," Napolitano argued.

The judge explained that he favors open borders as a natural human liberty, prompting Varney to say, "you're way out there on this one."

"This is the natural law, a natural right," said Napolitano. "Rights come from your humanity. It doesn't matter where your mother was when you were born."
