Judge Napolitano: 'Drone Court' Proposed by Senators Is Unconstitutional
President Obama’s use of drone strikes has a group of senators so concerned that they’ve proposed forming somewhat of an “assassination court” to review potential targets before the commander-in-chief makes a decision to eliminate them.
Fox News’ senior judicial analyst Judge Andrew Napolitano appeared this morning on Fox and Friends to discuss the legality and constitutionality of such a panel.
“I’m not for the panel, and I don’t think the panel is consistent with the Constitution at all,” said Napolitano, explaining his belief that the president and this proposed “court” do not have the power to authorize a kill in the first place.
“The Constitution says
[that] if the government wants to interfere with your life, liberty and the pursuit of happiness, because it believes you’ve done something wrong, it can only do so through due process,” added Napolitano.
“The authority simply doesn’t exist, and it’s denied expressly by the Constitution.”
