Ohio Bartender Twyla DeVito Fired After Calling Police on Drunk-Driving Customer

Twyla DeVito thought she was doing the right thing, and now she’s been fired for it. DeVito was a bartender at the American Legion Post in Shelby, Ohio. When a regular customer appeared drunk and drove home from the bar, she called the police. Cops pulled the man over and he blew twice the legal limit on a breathalyzer test.

DeVito was subsequently fired and told by her employer that “it’s bad for business to have a bartender that will call the cops.”

She doesn’t regret her decision, saying, “I stand by what I did and I would do it again.” So, was DeVito’s firing legal? That was the topic of today’s Kelly’s Court debate. Former prosecutor David Wohl argues that the employer acted within his legal rights. “If she calls family, she calls his wife, she calls his son or daughter, she calls a taxi – fantastic! Great ideas, all of them. But to call the police […] It’s the kiss of death for the business to do that kind of thing.” Defense Attorney Mark Eiglarsh disagreed. “Last year alone, 16,000 people were killed at the hands of a drunk driver. That’s on one side of the scale. The other side of the scale –well, it’s the strong desire to sell fuzzy navels and tequila shots. This is a no-brainer.”
