WATCH: Texas State Rep. Steve Toth Explains His Proposal to Ban State Police From Enforcing Federal Assault Weapons Ban

A Texas state lawmaker has proposed a new bill that would make it a crime for a state police officer to assist the federal government's efforts to ban assault weapons.

State Rep. Steve Toth (R) talked to Peter Johnson Jr. this morning on Fox and Friends. Johnson Jr. specifically asked why this proposal does not violate the Constitution, which gives

federal laws supremacy over state laws.

Toth said that in drafting the bill, he was "very careful" not to step over that legal boundary.

We're not going after federal officials. We're simply saying state officials within the state of Texas are not allowed to violate our Second Amendment as it pertains to these two things," said Toth, referring to the types of weapons and magazine that the Obama administration wants to ban.
