Will Mayor Bloomberg Win Soda Ban Case on Appeal?
On Monday, a Manhattan judge canned Mayor Bloomberg's proposed ban on over-sized sugary sodas - a limit set to take affect Tuesday. Bloomberg reacted to the decision, saying, "I think the judge is totally in error in how he interpreted the law, and we're confident we'll win on appeal." But, will he?
Fox News legal analyst Peter Johnson, Jr. gave his expert insight on Fox and Friends, saying that at this point, it's a toss-up.
"I believe it's a 50-50 shot at this point," he said, adding that the case probably won't be decided by the end of Bloomberg's term as mayor.
"Obesity is a problem in New York City, diabetes is a problem ... but how does the government regulate it? In this particular case, it was an administrative regulation of the Department of Health, not a [law] by elected city council people."
