Details From Affidavit: New Suspects Purposefully Threw Tsarnaev Evidence Away to Protect Him

Catherine Herridge provided an inside look at the complaints outlined in the affidavit filed against the three new suspects in the Boston bombing.

According to the affidavit, the three suspects believed at the time that they disposed of Dzhokhar Tsarnaev’s computer and a backpack containing fireworks that they were doing so to help their friend. The suspects had seen the FBI surveillance video released of the Tsarnaev brothers earlier in the evening.

The complaint reveals that a month earlier, Tsarnaev had said to two of the suspects that he knew how to make a bomb.

Other highlights include:


  • On April 18, 2013, Kadyrbayev and Tazhayakov removed Tsarnaev's backpack from Tsarnaev's dormitory room. Kadyrbayev and Tazhayakov have admitted that they agreed to get rid of it after concluding from news reports that Tsarnaev was one of the Boston Marathon bombers.
  • After they became friends in the fall of 2011 and better friends in he spring of 2012, Kadyrbayev told investigators he repeatedly visited Tsarnaev's home and met his family members.
  • Two days after the bombings, Kadyrbayev's drove to Tsarnaev's dormitory and texted him to come down and meet them.  When Tsarnaev came down, Kadyrbayev noticed that Tsarnaev appeared to have given himself a short haircut.
  • Kadyrbayev then texted Tsarnaev and told him that he looked like the suspect on television. Tsarnaev's return texts contained "lol" and other things Kadyrbayev interpreted as jokes, such as "you better not text me" and "come to my room and take whatever you want."  An analysis of Kadyrbayev's cell phone reflects that these texts were sent on April 18, 2013 between 8:43pm and 8:48pm.
  • The three - Kadyrbayev, Tazhayakov and Phillipos spent some time inside Tsarnaev's dorm room, watching a movie. They noticed a backpack containing fireworks. The fireworks had been opened and emptied of powder.  Kadyrbayev knew when he saw the empty fireworks that Tsarnaev was involved in the Marathon bombing. He decided to remove the backpack from the room in order to help his friend Tsarnaev avoid trouble. He decided to take Tsarnaev's laptop as well because he did not want Tsarnaev's roommate to think he was stealing or behaving suspiciously by just taking the backpack.
  • They collectively decided to throw the backpack and fireworks into the trash because they did not want Tsarnaev to get in to trouble. 
  • On April 26, 2013 law enforcement agents recovered Tsarnaev's backpack from a landfill in New Bedford where they believed it to have been dumped by the service that removes garbage from the Carriage Drive apartment complex. The backpack was partially enclosed in a black garbage with red drawstring handles. Inside the backpack, the agents recovered fireworks, a jar of Vaseline, and a UMASS-Dartmouth homework assignment sheet, among other things.
