'Factor' Investigation: Man Avoids Jail Time After Conviction in Child Rape Case

A man who investigators say raped a 7-year-old girl for five years has avoided jail time, The Factor reported in its “Is It Legal” segment.

A prosecutor allowed 47-year-old Gary Hegna to plead down from multiple rape charges to third-degree criminal sexual misconduct. Minnesota District Court Judge Donald Rysavy accepted the plea bargain, sentencing him only to 15 years of probation.

The prosecutor’s office would not explain to “Factor” producers why Hegna was allowed to plea down.

Attorney Eboni Williams said she suspects that they did not have a cooperating witness on the case.

Fox News legal analyst Lis Wiehl disagreed with Williams, noting that the victim came forward to a social worker about being raped.

The law in Minnesota is a watered-down version of “Jessica’s Law,” Wiehl said. If Hegna was convicted of rape, he would have gotten a mandatory minimum sentence of 12 years in prison.
